May Moncur

I’m May Moncur

Senior Employment Law Advocate

I have been working as an employment advocate for 13 years, specialising in migrant related employment issues.  New Zealand has very clear employment laws and I believe everybody deserves to have their rights upheld.May Moncur

13 Years of Experience in Employment Law

May is very well respected in the NZ Employment Law community. She has many years of experience with assisting clients with raising grievances and attending mediation and employment court, supporting both employees and employers. May also speaks Chinese and she has helped many migrant workers with employment issues, including exploitation. You will often find May in the news, drawing attention to the unfair treatment of employees in New Zealand.

Hi May,

Just wanted to let you know that I think you’re a legend, I just read the RNZ article you are quoted in and it is great to see someone really holding our government agencies accountable on this issue.

In my opinion the treatment of migrants to New Zealand under recent immigration settings has been scandalous and the lapse framework has allowed criminal behaviour to go unchecked. Also, unfortunately, with Immigration NZ – usually it is the Migrant themselves that bears the brunt of any action that is finally taken and it seems like their deportation or leaving the country (sometimes in debt) from INZs perspective is seen as a reasonable resolution of the issue.

Anyway, I just wanted to say I thought you had it bang on in all your comments and just wanted to thank you. Hopefully with more attention this can lead to change and better outcomes to people who choose to try build their life here.

King regards,

Matt

She’s a professional, deligent and problem-solving lawyer with a good communication. She concerns about customer’s requests and offers a possible maximum of benefit for the customer too. All works and case disscusion did on a remote way that saved the time and also have not influenced on output the good outcome.

May's cases are often in the media:

Browse through the articles below to see some examples of employment law cases that May has represented.

Air China tried to silence an employee who spoke up

Air China demanded a former employee stop speaking out after she alleged she was sacked following her refusal to join a cigarette smuggling ring with fellow airline staff.

May Moncur said the airline was “abusing their power” by trying to strong-arm her client into silence.    The ERA case against the airline has now been successful and the media is free to cover the case as it is public knowledge.

It’s not an exaggeration to say that without May’s representation, this case could have ruined her client.

Mansion-building firm charged worker thousands for job and sacked him a week later

An Auckland construction company used a Singapore agency to charge a migrant thousands of dollars in fees to get a job, and sacked him after a week.

The Employment Relations Authority heard 6 Meter Homes was accredited to recruit dozens of migrants for its two firms, but was likely to have known and profited from the agency charging an $11,000 job premium.

The Rosedale-based business was ordered to pay more than $46,000 in compensation, fines and lost wages.

One of its directors, Wenbin Hua, had to pay $6000 of that for seeking a premium from migrant worker, Shunxu Zhou.

Zhou was charged a premium to get a carpenter’s job with 6 Meter but he was sacked a week after starting.

He was recruited from Singapore, along with at least four others, and paid the equivalent of about NZD$11,700 over 2022 and 2023 to get a job and visa.

“The amount of money Mr Zhou was required to pay was significant from his perspective,” said authority member Nicola Craig in her decision.

“He spent all his savings, as well as borrowing money, to pay the fee, hoping to create a better future for his family.”

Chinese Radio host who resigned after workplace altercation awarded $18,000 compensation

May Moncur represented a Chinese Radio host, who has been awarded $18,000 in compensation after he was unjustifiably dismissed over an altercation with another staff member.

Tax-evading businesswoman made migrant graduate pay $90k in exchange for employment, residency reference

Desperate to make a life for himself in New Zealand, Wang submitted hundreds of job applications before being offered a role as the bookkeeper for Gill’s business.

The only catch was that the young graduate was required to pay her a sum of $90,000 in exchange for the job. In return, Wang would also be allowed to use his new boss as a reference to assist with gaining residency.

Woman in Auckland awarded $25,000 after boss calls her 'f***ing hopeless'

A woman whose employer told her she was “f***ing hopeless and “f***ing stupid” and was subjected to a number of incidents of workplace bullying has been awarded $25,000 in compensation and lost wages.

Indian priests say they have been exploited by employer

Two Indian priests (or granthi) say they have been exploited since coming to work in New Zealand, earning just $2000 and $1000 respectively for six months’ work.

Employment law advocate May Moncur is acting on behalf of the two men and has come across similar cases involving the Sikh community. “We’re trying our best to make sure that this doesn’t happen in the future by highlighting those cases, so the employers think twice before they’re trying to take advantage of the religious workers who are not aware of their rights.”

Chinese migrant workers: ‘We’ve been cheated’

A group of migrant Chinese workers say they are still waiting for new visas and some are still looking for work after falling victim to a scam.

Auckland restaurant worker awarded $20k after Covid-19 wage subsidy dispute turns sour

An Auckland restaurant has been ordered to pay $19,000 in compensation after unjustifiably dismissing a waiter whose husband questioned whether she was paid correctly following a Covid-19 wage subsidy claim.

The Employment Relations Authority (ERA) has found that Penrose business Good Food Vibes, trading as Big Fish Eatery, unjustifiably dismissed casual worker Alexis Dietz after the nationwide lockdown in 2020.

Good Food Vibes must pay Dietz $1939 in lost wages and $19,000 in compensation.
